Terms of Service

These Terms of Service ("Terms") govern your access to and use of Quiet Aha (the "Service"), operated by SMALL WONDER WORKS INC ("we", "us", or "our"), a company located at 28B S State St, Salt Lake City, UT 84111. By creating an account or using Quiet Aha, you agree to be bound by these Terms.

1. AI-generated content disclaimer

Anything Quiet Aha produces is generated automatically by the AI models we operate, and does not represent the views of SMALL WONDER WORKS INC. Verify factual, medical, legal, or financial information independently before relying on it. We are not liable for decisions made on the basis of the output.

2. The Service

Quiet Aha provides reflective thinking features — reframing a problem, sharpening the question, distilling the core of something, drawing analogies, and offering a prompt to sit with — running on AI models that we deploy and operate ourselves on infrastructure under our control. Output is generated automatically — it may be inaccurate, incomplete, or unsuitable for your use case.

3. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, SMALL WONDER WORKS INC will not be liable for indirect, incidental, or consequential damages arising from your use of the Service, and our total liability will not exceed what you paid us in the twelve months before the claim arose.

4. Moments and payments

  • Use of Quiet Aha's AI features is metered in Moments. Nothing is granted when you register — the balance starts at zero — and Moments are acquired only by buying them on the Pricing page.
  • Moments are bought through the Pricing page. Payments are handled by a third-party payment processor. Available methods — Apple Pay, Google Pay and Cash App Pay — depend on your device, region, and browser.
  • Charges appear on your statement as QUIETAHA. If you see a line you do not recognise, check for that name first.
  • A Moment is consumed when a request completes, whether or not you are satisfied with the result — except where the Service fails to return anything because of a technical error, in which case nothing is charged.
  • Moments have no cash value and cannot be transferred. Unless the law requires otherwise, they are non-refundable once used. See our Refund Policy for refund eligibility on unused purchases.

5. Intellectual property

The Quiet Aha name, logo, and site design belong to SMALL WONDER WORKS INC. Subject to these Terms, you may use output you generate for personal or commercial purposes, but it is your responsibility to make sure that use complies with the law and with any third-party rights.

6. License to use the Service

Subject to these Terms, SMALL WONDER WORKS INC grants you a limited, non-exclusive, non-transferable licence to access and use Quiet Aha for your own personal or internal business use. Except where applicable law expressly allows it, you may not sell, copy, modify, interfere with, reverse engineer, exploit, or otherwise misuse the Service.

8. OFAC sanctions and geographic restrictions

We comply with trade sanctions, export control laws, and regulatory requirements enforced by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), as well as other applicable international and U.S. federal and state trade restriction laws. We do not offer, sell, ship, deliver, or facilitate transactions for individuals, entities, jurisdictions, or regions subject to comprehensive or targeted U.S. sanctions — including without limitation Cuba, Iran, North Korea, Sudan, Syria, and the restricted regions of Ukraine (Crimea, Donetsk, Luhansk) — or for any party on OFAC's Specially Designated Nationals (SDN) List, Blocked Persons List, or other applicable sanctions lists.

You represent and warrant that you are not located in, organised under the laws of, or a resident of any sanctioned jurisdiction, and that you are not listed on any U.S. or international government sanctions, watch, or restricted-party list.

We reserve the right to cancel, suspend, reject, or terminate any order, transaction, account, or access at any time, without prior notice or refund eligibility, if we reasonably determine that it involves sanctioned territories, restricted parties, or a breach of OFAC trade control regulations. We bear no liability for transactions rejected or terminated to meet sanctions compliance obligations.

9. Eligibility and accounts

  • You must be at least 18 years old, or the age of majority where you live, to create an account.
  • You are responsible for keeping your login details confidential and for everything done under your account.
  • Give accurate information when you register, and keep it current.

10. Changes to these Terms

We may update these Terms from time to time. Continuing to use the Service after a change takes effect means you accept the revised Terms.

11. Acceptable use

You agree not to use the Service to:

  • Generate or distribute unlawful, defamatory, hateful, or sexually exploitative content, or any content involving minors.
  • Produce political propaganda meant to manipulate opinion at scale, disinformation presented as fact, or content inciting violence or hatred.
  • Work around Moment metering, rate limits, or safety controls.
  • Reverse engineer, scrape, or resell access to the Service without our written permission.
  • Build a competing product using our systems or outputs at scale.
  • Use bots, scripts, or other unauthorised automation against the Service.
  • Manipulate payments or Moments, or interfere with our infrastructure, other users, or normal operation.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law principles. If a dispute arises, contact us first so we can try to resolve it informally. Any controversy or claim that cannot be resolved informally shall be settled by binding arbitration administered under the rules of a recognised arbitration association, seated in Utah unless otherwise agreed, and judgment on the award may be entered in any court having jurisdiction. You and SMALL WONDER WORKS INC each waive any right to bring a claim as a plaintiff or class member in a class, collective, or representative proceeding.

13. Service availability and changes

We may add, change, suspend, or discontinue any part of the Service at any time, with or without notice. The Service depends in part on the infrastructure that runs our models, our payment processor, and our hosting provider; their availability, performance, or policies can affect it. We are not liable for interruptions outside our reasonable control.

14. Termination

We may suspend or terminate your account if you breach these Terms. You may stop using the Service at any time. Unused Moments are handled under our Refund Policy when an account ends.
